The Medicare Birthday Rule is a state-level consumer protection law that gives Medicare Supplement (Medigap) policyholders a guaranteed-issue window each year around their birthday. During this window, you can switch to a plan with equal or lesser benefits from another carrier — without answering health questions or going through medical underwriting.

Outside of your initial Medicare enrollment period, insurers can normally deny your Medigap application or charge you more based on your health history. The Birthday Rule removes that barrier once a year, giving you real leverage to shop for lower premiums.

You can switch to a plan with equal or lesser coverage. You cannot use the Birthday Rule to upgrade to a higher-benefit plan.
